The Howard County Drainage Board approved Resolution HCDB 2604 consenting to an encroachment on the county statutory right of entry under Indiana Code IC 36‑9‑27‑33 for a homeowner at 3388 West 400 South. The applicant, Beth Lucas, told the board she plans to add to an existing small concrete area and described the proposed addition as roughly a 20‑by‑20 pad; staff recorded the design on the exhibit as a 22‑by‑20 deck off the north side of her house.
"We are just wanting to add, we already have, like, an existing small little concrete little thing right there in the back. We just wanna add to it," Beth Lucas said, describing the project and acknowledging she understands potential encroachment consequences. Staff and board members confirmed the proposed addition would be further from the regulated drain than the house and that the encroachment is less severe than the existing house encroachment. The Chair read the resolution language referencing the county statutory right of entry under IC 36‑9‑27‑33 before the board voted to approve the consent.
A motion to approve the resolution was recorded as moved by Mr. Byram and seconded by Mr. Olery; the motion passed by voice vote with no roll‑call recorded. Staff instructed the applicant to have the recorded document notarized and returned to county staff to complete the process.
