Steve Sheehan testified that the drainage structure in the right-of-way at 11 Coconut Lane was clogged by vegetation and that a disused mailbox post remained in the right-of-way; staff characterized the case as a repeat maintenance violation. Sheehan said stagnant water posed a nuisance and required clearing of vegetation and obstruction removal to restore drainage.
The magistrate found violations of the town's maintenance and appearance code sections (30-173 and 34-162), ordered that the property be brought into compliance by 08/07/2026 and set a $250 per day fine for each day the violations continued thereafter; the magistrate also assessed administrative costs of $314 for the hearing. Staff indicated the notice of violation had been hand-delivered and a witness at the hearing corroborated delivery.
