The City of Farmington council voted to adopt an electronic mail retention policy aimed at ensuring compliance with state public-record laws and reducing storage burden. Peter, a city staff member presenting the policy, told the council that Minnesota law treats some emails as official public records and that the city follows the general records-retention schedule for Minnesota cities. "The policy I'm presenting for council approval tonight ensures we meet those legal obligations while also reducing risk and providing consistent guidance to staff and counsel," Peter said.
Council discussion focused on legal holds and when emails would be preserved. Holly, who had pulled the item from the consent agenda to allow public discussion, said she wanted transparency and clarity on retention periods and litigation holds. Steve asked whether a litigation hold would apply only when litigation is filed or also when something might later become litigation; Amy (staff/counsel) replied that a litigation hold is issued when litigation has been filed, threatened, or when counsel receives a preservation request, and reiterated that following the schedule protects the city from spoliation claims. Phil moved to adopt the policy and Holly seconded; the council recorded roll-call votes with all members present voting yes and the motion passed.
