Committee member (speaker 3) read the applicant's written statement apologizing for the oversight and said the gate was installed in good faith without realizing a board review was required.
"I acted under the mistaken good faith and belief that an in-kind replacement of an existing accessory structure did not necessitate a formal building permit or board review and sincerely apologize to the board and planning department for this oversight," the applicant's statement (read by Committee member) said. The board noted the previously approved 2019 filing described a 5-foot-6-inch wooden split-rail fence and gate but observed the present gate does not read as a split-rail design even though it conforms to the 5'6" height above grade.
Board members also discussed process and recordkeeping: because this is a retroactive application, members asked for measurable documentation so future applicants could match the approved design precisely. The board requested the applicant provide plank width, the gap between boards, post-to-post width and confirmation that the gate's finish would be recorded as "naturally weathered." The homeowner (speaker 9) agreed to provide the requested measurements.
After the documentation requirement was spelled out, a board member moved to approve the retroactive application conditioned on inserting the agreed measurements and weathering description in the ARB resolution; the motion was seconded and the board voted in favor. The resolution will record the specific dimensions so future restorations and replacements can be judged against the documented as-built condition rather than an ambiguous photographic submission.
