The Keizer Internal Oversight Committee unanimously agreed to accept an outside investigator's report finding that Mayor Clark violated council rules 5.2 and 15.1, the committee learned during a reconvened meeting that began at 3:15 p.m.
City Attorney Joe Lindsey summarized the investigator's conclusions: "the investigation found that 5.2, which is how councilors treat each other, was founded," and that the inquiry also found a violation of 15.1 while a 16.1 allegation was not founded. Lindsey told the committee that the group must determine whether the misconduct is "founded" and then follow the procedures in Rule 16.1.
The chair moved that the committee accept the investigator's findings "as stated in the report by the outside attorney investigators," the motion was seconded, and the committee registered a unanimous voice vote in favor. City Attorney Lindsey said a unanimous finding under sub-section d of Rule 16.1 requires the committee to present the investigation's conclusion and a recommendation to the full city council.
The committee did not impose a sanction at the meeting; instead it voted to forward the investigative conclusion and a recommended response to the full council for its consideration and any further action.
