Council adopts ordinance allowing temporary-construction-easement condemnation for 55th Street improvements

Council voted to adopt an ordinance that would allow the city to file for condemnation only as a last resort to secure temporary construction easements needed for 55th Street sidewalk and driveway-tie-in work. City attorney Keith Moody explained the easements are intended to create gradual driveway transitions and that easements terminate when construction is complete.
Moody told the council the listed properties are those from which temporary easements had not been secured and that, if those easements are obtained later, the properties can be removed from any court filing. He emphasized the city’s approach seeks to avoid taking land and to replace or compensate for plantings removed for construction.
Council adopted the ordinance by voice vote after brief discussion and no amendments.
