Applicant attorney warns moratorium may target project, urges board not to pass or to shorten it

Sarah Campbell, an attorney representing applicants Fritz Veil and Abe Salati, told the Vestal board that the applicants have worked with the planning board and revised their application and asked the town not to pass the moratorium or to limit its duration. "We would request that you not pass this moratorium, or if you are going to pass it, to modify it so that it is not of such a long duration," Campbell said, noting the draft's one-year period with a possible additional 12-month extension.
Campbell argued the property is in a general shopping district where a restaurant use is permitted by right and said a moratorium that singles out the pending project could be inappropriate; she also said that if the moratorium were targeted it could implicate the applicants' rights under a special-facts exemption. The board did not alter the draft’s duration during the meeting and proceeded to adopt the moratorium.
