Commission grants waivers and order for pool, with new condition limiting well use for filling
Summary
The commission approved two waiver requests and issued an Order of Conditions for a pool, patio and pavilion at 26 Domenely Drive. Commissioners added a special condition that pools be filled by licensed off-site suppliers rather than be supplied from on-site private wells, to protect groundwater-dependent wetlands.
After reviewing updated plans and special conditions, the commission granted two waivers under its grandfather policy to allow a pool and associated structures within no-structure and no-disturb setback areas, and voted to issue an Order of Conditions with twenty-plus special conditions. Staff explained the mitigation plantings and monitoring and recommended the waiver fee for plantings be waived.
Janet proposed a new condition that “the swimming pool cannot be filled, topped off, or otherwise supplied with water from any on-site private well, irrigation well, or groundwater withdrawal located on the property” to protect the town’s groundwater resources and nearby groundwater-dependent wetlands. Commissioners discussed limited exceptions for minor evaporation topping (inches), and the group agreed to retain the restriction while clarifying routine small top-offs could use a private well. The order and waivers were approved by roll-call vote.
