Beverly council keeps lien on Beverly Marathon Garage after settlement offer

The Beverly Town Council met in a special session on Sept. 30, 2024, at 6:30 p.m. in council chambers to discuss the lien on Brad Reed’s property, known as the Beverly Marathon Garage. Mayor Andy Burns called the meeting to order and the council considered a proposal reported to the town: Mr. Reed’s counsel had contacted Rob Chenoweth, the town’s counsel, saying Mr. Reed would give the settlement amount to the town if the town removed the lien from his property. Council members noted the town is not a party to Mr. Reed’s court proceedings and therefore cannot unilaterally remove the lien.
After discussion the council left the lien in place "as it was ordered on August 13, 2020." The minutes record that no motion was required to maintain the lien because the town is not a party to the underlying litigation. The meeting record lists Mayor Andy Burns, Council members Connie Pingley, Matt Lewis and Kenny Pritt, Recorder Sheila Scott Strahin and Town Clerk Robin Wilson as present. Matt Lewis moved to adjourn; Katie Whittaker seconded. The council voted "all in favor," and the meeting was adjourned.
