Council adopts 2024 Uniform Public Offense Code after failed tabling attempt (Ordinance No. 5496)

During discussion Councilmember Joshua Swanson moved to table the item; the motion was seconded by Councilmember Blaine Heble and produced a tie in the tabling vote. Mayor Clark Shultz cast the tie-breaking vote to not table the item. The council then moved to adopt Ordinance No. 5496; the motion to adopt was moved by Councilmember Rebecca Van Der Wege, seconded by Councilmember Kirsten Bruce, and passed 6-2 with Councilmembers Blaine Heble and Joshua Swanson voting no.
The minutes list UPOC changes that include an amended Section 9.1 on Disorderly Conduct and amendments to sections addressing unlawful possession of marijuana and tetrahydrocannabinols (9.9.1), possession of drug paraphernalia and certain drug precursors (9.9.2), and unlawful possession of controlled substances (9.9.4). The council did not adopt the tabling motion and approved the UPOC updates for municipal enforcement in city court.
