Board adopts amendments to Lincoln-Lancaster County air pollution rules to align with state Title 129

Lancaster County commissioners on July 21 adopted Resolution R-26-0055 to amend portions of the Lincoln-Lancaster County Air Pollution Control Program Regulations and Standards (Article 2, Sections 1, 14, and 17) to maintain consistency with Nebraska Department of Water, Energy, and Environmental Title 129.
Gary Bergstrom, Environmental Health Supervisor at the Lincoln-Lancaster County Health Department, told the Board the revisions "were intended to maintain consistency with the Nebraska Department of Water, Energy, and Environmental Title 129 Air Quality Regulations." He explained the amendments create a procedure to rescind construction permits when permitted equipment has been permanently removed or decommissioned and the owner no longer wishes to maintain the permit requirements.
Bergstrom said the proposed changes had already been reviewed by the Air Pollution Control Advisory Board and by the Lincoln City Council, which approved the amendment on July 13, 2026. County and City attorneys also reviewed the revisions for consistency with state law. The Board voted 5-0 to adopt the resolution.
