Councilman Abens moves ordinance to increase fines for through truck traffic, citing safety concerns

Councilman Abens presented Ordinance 2026-64 to the Committee of the Whole on July 20, explaining the measure would amend Section 440.17 of the codified ordinances to establish enhanced penalties for through truck traffic on residential roads.

Abens said many of the roads in his ward are used heavily by truckers who ignore warnings; he told the committee that verbal warnings and the current low fines have failed to deter repeat offenders. He proposed a first-offense fine of $150 plus court costs (estimated to total about $250 including fees) and a $500 fine for a second offense within two years. "I thought that a $150 plus court costs for the 1st time will send the message," Abens said, adding the larger second fine would provide stronger deterrence.

Abens framed the ordinance as a public-safety measure, noting risks from overturned trucks and the possibility a load could contain hazardous materials on residential streets. Committee members agreed with the goal but raised enforcement concerns: one member said the city has laws it must be willing to enforce and questioned capacity to issue consistent citations. Abens said choosing $150 was partly intended to keep cases in Mayor's Court rather than pushing defendants to a neighboring jurisdiction (Elyria) where fines would not return to North Ridgeville.

After discussion and public comment, the committee voted to send Ordinance 2026-64 back to council for further consideration; the clerk recorded an affirmative roll call.
