The Key Colony Beach City Commission unanimously approved a construction agreement with Pedro Falcon Contractors using the AIA Standard Form of Agreement A101-2017. Assistant City Attorney Scott Black told the commission that Pedro Falcon made no changes to the agreement and that several modifications in the A101 were budgeting-driven, limiting compensation to the current fiscal year’s allocation.
Commissioners discussed timing and conditions for issuing the Notice to Proceed (NTP). Mayor Freddie Foster requested a checklist of required documents and suggested a Dec. 1 target for issuing the NTP once a building permit and other prerequisites are in place. Commissioner Kirk Diehl moved to approve the contract; Commissioner Tom DiFransico seconded, and the roll-call vote was unanimous. The commission also agreed that staff and legal would provide hard quotes and final wording on remaining insurance and bond items before final execution.
