River Heights City Council voted July 7 to approve a Non‑Exclusive Public Right‑of‑Way (ROW) License Agreement with Google Fiber Utah, LLC after prior attorney review and follow‑up answers from the fiber representative.
Councilmember Lance Pitcher summarized that Google Fiber and comparable cities typically collect a 2% franchise fee on gross revenues; the council had previously requested 4% but was told 2% is standard in the provider’s agreements. The draft agreement requires Licensee to obtain individual encroachment permits, perform work at its own cost, repair any damage it directly causes to the public ROW, maintain insurance and a performance bond, provide as‑built drawings (subject to GRAMA protections), and pay a License Fee equal to two percent (2%) of Gross Revenues. The agreement provides for public, documented relocation or removal in emergencies, and allows the City to require relocation for governmental purposes with reasonable notice and at Licensee’s expense.
Councilmember Pitcher moved to approve the Non‑Exclusive Public ROW License Agreement dated 3‑25‑26 as reviewed by the city attorney, with the administrative edit of replacing references to 'Logan' with 'River Heights' in the contract; the motion passed with Evans, Malmstrom, Milbank, Pitcher, and Roberts in favor. Council directed staff to obtain a finalized, signed contract reflecting the city’s name and the reviewed provisions.
