Council adopts zoning change to allow schools in commercial districts via CUP

Planning director Jeff Ray told the council that an amendment to the Unified Development Code would restore flexibility to allow primary and secondary education uses in general commercial and neighborhood commercial zones through conditional use permits.
Ray said the earlier version of the code removed that allowance and that surrounding communities commonly permit schools in commercial districts with safeguards. He told council staff and the planning commission recommend approval and cited potential interest from a private education applicant that has looked at general commercial sites for a new high school.
Councilmember Horner moved approval of the first reading and then moved to suspend the rules; the council voted unanimously to adopt Ordinance 57‑34 on final reading the same night.
The ordinance amends Ordinance 57‑30 to restore conditional use permit authority for primary and secondary education in specified commercial zoning districts. Councilors said the CUP process preserves review protections for adjacent neighborhoods while allowing potential education uses to pursue siting in commercial corridors.
