First, the materials referenced slightly different encroachment dimensions — “approximately 2 feet and 2 ft 3 3/4 of an inch” — and second, staff questioned whether the property’s nonparallel siting is unique within the neighborhood, which affects the hardship standard under ordinance 225‑8‑7F.
“Based on the planner's review, there are questions as to whether the standard of unnecessarily burdensome or unreasonable has been met,” Tanner said, and advised the board that the ordinance requires the decision to be based on the statutory criteria, not on perceived impact or small size alone. The planner recommended clarifying the exact encroachment measurement and documenting why alternate designs could not meet the setback requirement.
The board proceeded to discuss alternatives and ultimately voted to grant the variance despite the planner’s caution. The transcript records no administrative correction of the measurement discrepancy during the hearing.
