Staff noted the agreement establishes a not‑to‑exceed fee of $3.1 million (roughly 15% of the $21 million maximum potential award) and emphasized the fees must be earned through defined scopes and purchase orders, not simply paid up front. “The proposed contract establishes a not to exceed fee of 3.1 million, representing approximately 15% of the maximum potential of the W Sig award amount of 21 million,” the presenter said. Commissioners discussed how previously budgeted work and existing improvements would affect competitiveness; the board approved the contingent agreement unanimously. The agreement will advance only if TWDB funding is awarded.
