Palm Beach Shores adopts Comprehensive Plan EAR amendments on second reading

The Town Commission voted unanimously, 5-0, on Aug. 26 to adopt Ordinance No. O-5-23 on second reading, which transmits Evaluation and Appraisal Report (EAR)-based amendments to the town's Comprehensive Development Plan to the State Land Planning Agency. Attorney Barnard read the ordinance by title; representatives from the planning firm Schmidt and Nicols explained the language changes and state-required edits.
Presenters Josh Nichols and Matthew Wojciechowski described the updated private property rights element and proposed amendments to the Coastal Management Element to address flood perils pursuant to state statute. Commissioners pressed for clarification on how the Comprehensive Plan changes interface with existing town ordinances addressing marine uses and single-family land use. The minutes record: "Attorney Barnard read the Ordinance by title only. Josh Nichols and Matthew Wojciechowski from Schmidt and Nicols were present to discuss the Comprehensive Plan. Matthew presented the language, updates, and edits made to the Comp Plan. He also explained the requirements that the State imposed and suggested."
A public commenter identified as Jamie (Gavin), representing the owners of 123 S Ocean, asked whether zoning or future land-use changes would affect that property. Commissioner Kathleen McCahran moved to approve the ordinance; Commissioner Roby DeReuil seconded and the motion passed 5-0. The commission also recorded consensus to submit the plan to the State and to amend it again in the near future as necessary.
