Members of the council pressed administration about a recently filled deputy-director position in planning. Some councilmembers said they remember voting to remove or table the position during budget hearings and asked how a hire could proceed when the council had not approved the line as part of the final budget. "How is it possible that in a Faulkner government where we authorize suspending that a position was offered to an employee without our financial oversight?" one councilmember asked.
Administration and labor counsel described the hiring process as a conditional offer of employment (standard for nonunion hires) that was accepted; labor counsel advised that an offer and acceptance create enforceable obligations. Administration said the position was included in the introduced salary ordinance and that the hiring followed internal personnel prerogatives under the Faulkner form of government; the CFO indicated the salary was reflected in the introduced budget and that funding adjustments can be made among line items. Council asked for the written offer and documentation of the salary and requested another legal opinion about the council’s authority to withhold funding or reverse the hire.
Council members said they will follow up in the upcoming budget and asked administration to explain funding sources and potential liabilities if council votes later to defund the position.
