Rural Hall council acknowledges developer's annexation commitment for proposed data center, adopts Resolution 912 (3-1)

Town Manager Dearman presented a draft Resolution 912, saying the town had received written commitments from representatives of the DRS group that the developer intends to voluntarily petition for annexation and memorialize that commitment in enforceable written form. He told the council the resolution would supersede Resolution 901, withdraw the town's formal opposition to the project, and direct town representatives to engage on annexation, fiscal impacts, community benefits, infrastructure, environmental considerations and other matters affecting Rural Hall.
"The proposed draft resolution 912 would supersede resolution number 901 and acknowledge the developer's written annexation commitment," Dearman said. He emphasized the resolution preserves the council's ability to take future action should circumstances warrant.
During discussion council members and commenters weighed the changed site plans and trade-offs: the project was described in meeting comments as three buildings (not four), with increased setbacks and changes to fencing; officials emphasized that concerns about public safety encompass fire and EMS as well as law enforcement. The mayor told the room the issue had generated many emails and a roughly two-to-one split among correspondents. One council member and multiple public commenters said the proposal is inconsistent with area plan recommendations and could threaten neighborhood protections; a commenter identified as Michael urged the council to note the inconsistency with the town's area plan and the 2045 plan.
The meeting record shows attendees also referenced a county planning board recommendation reported as 7-2 and raised the pending state bill SB730 addressing data center guidelines; developers reportedly said their plan would comply with the state requirements if enacted.
After discussion a council member moved to adopt Resolution 912. The council voted 3-1 to adopt the resolution. The resolution acknowledges the developer's annexation commitment and directs staff to pursue negotiations and impact assessments while reserving the council's right to take future action; it also withdraws the town's formal opposition. The motion carried with applause and the meeting proceeded to adjourn.
