Council adopts ordinance to vacate 25-foot public right-of-way, reverting it to prior owner

The Hillsborough City Council voted unanimously to adopt Ordinance 14-19, vacating a 25-foot strip of public right-of-way between Lot 1, Block 4 and Lot 1, Block 3 and directing that the land revert to the previous owner under KSA 12-5-006. Mayor presided over the hearing and called for public input; staff told the council no utilities were located in the easement following a locate, and legal counsel confirmed the statutory reversion process.
Miss Bartle told the council the ordinance would return the right-of-way to the prior owner and recommended that neighboring owners obtain a survey if ownership boundaries become disputed. "This ordinance, as mentioned, would allow the 25 foot right of way to go back to the previous owner," she said. Councilman Wilkins moved to adopt the ordinance, Councilman Jorgensen seconded, and the council polled in favor; the mayor will sign the ordinance.
