The Council on June 1 voted unanimously to defer consideration of Resolution No. 2026-06-07R, which would allow a gas station at 200 109th Ave., until its July 6 meeting to permit further legal review of materials that were submitted at the meeting.
Attorney Brian Woodward, representing nearby interests, told the Council he was concerned that the property's Request for Equitable Adjustment (REA) and existing covenants could reproduce a situation in which construction at a Merrillville site was halted. Petitioner representatives and planning staff said an updated Declaration of Use Restrictions had been recorded and forwarded to city staff; Russ Pozen and Chris Pacanowski presented on behalf of Lucky Quick Run, Inc. Council members and City legal staff agreed additional review was warranted before a final vote, and Member Laura Sauerman made the motion to defer. The item is scheduled for the July 6, 2026 Council meeting for further consideration.
