The Oak Hill City Commission voted 3–2 to approve a variance for 508 Cheyenne Drive that allows reconstruction and enlargement of an enclosed carport and associated porch within an existing nonconforming setback.
The applicant explained the work will restore and enlarge a carport and create an ADA-compliant primary entrance; he said the current footprint predates his purchase and that prior permits and a 2006 enclosure are in the packet. "I didn't create that problem, I just bought that problem," the applicant said, explaining he had demolished a deteriorated carport and now seeks to rebuild in the same footprint but with improved access.
Staff and planning documents in the packet noted the structure sits within the setback and staff had no record of a previously granted variance for the footprint. Commissioners debated whether approving a variance would set an undesirable precedent and asked about stormwater impacts; the applicant and some commissioners said the rebuilt footprint will not increase impervious area relative to existing conditions and that neighbors had provided written support included in the application packet.
After a motion and second, the roll call recorded three affirmative votes and two negatives; commissioners who opposed cited concerns about precedent and future requests, while supporters emphasized the limited scope (two feet) and the existing condition. The applicant was told he may apply for permits once notified that the variance has been formally recorded and processed by staff.
The commission’s decision allows the applicant to pursue permits and move forward with demolition and reconstruction under the approved variance.
