Legal counsel outlines options to remove abandoned RV from Port LaBelle district property

District counsel told the board July 24 that an abandoned RV reported on district property is subject to Florida Statute Chapter 705 procedures and that Hendry County must provide owner notice before county or district disposal; the board may work with the county to remove or scrap the RV.
At the July 24 meeting District Attorney Amy Thibaut reviewed legal options for removing an abandoned RV from district property. Thibaut said Florida Statute Chapter 705 governs disposition of abandoned property and that the county must provide the required notice to registered owners; if the notice has been provided and 21 days have passed, the County may either allow the district to retain the RV or retain custody and dispose of it. "If they have and if at least 21 days have transpired since the notice was provided the County, then elects whether to allow you to retain the property or they can retain custody of the property and thereafter dispose of it," Thibaut said.
Kennington-Korf told the board the district has multiple abandoned items on its property that create disposal costs; Thibaut said Code Enforcement may also be notified and the district can coordinate with Hendry County for removal. No final disposal action was taken at the meeting; staff were directed to continue coordination with county authorities and follow statutory notice procedures if applicable.
