The Orono Planning Commission narrowly approved an after‑the‑fact average‑lakeshore‑setback variance for a new house, pool, patios and retaining walls at 3125 Casco Circle.
Staff acknowledged an administrative error in earlier building‑permit reviews that allowed permits to be issued without identifying the lakeshore setback problem. Nevertheless, staff recommended approval of a variance for the accessory structures, noting site constraints — including a roughly 50‑foot drop from street to ordinary high water level — and the practical difficulty of siting a walkout home, pool and patios without grading and retaining walls.
Applicants and their builder (NIH Homes) said the current grades reflect the historic contours and that the proposed improvements are consistent with neighboring properties and require containment for stormwater. Neighbors—including Kent Ritchie and Stacey Marks—contested the claim, saying the walls approach 8 feet in places, significantly alter their views and have caused muddy runoff onto adjoining lots.
Commissioners were split. Supporters argued the improvements are outside the immediate lakeshore and staff provided mitigation plans including landscaping and retained sight lines; opponents focused on view impacts and the fact the grading was driven by a pool and owner choices. After debate the motion to approve passed 4–3. Commissioners Tift, Wilson and Perkle recorded the dissent.
