Council authorizes 350 North waterline mitigation after $12,500 bid; attorney says no recourse against developer

Councilmember Terry Larson reported on bids to loop the 350 North water line into the system and stated the bid amount was approximately Twelve Thousand Five Hundred Dollars ($12,500). Attorney Lyle Fuller advised the council he was not able to identify any good legal theories by which the city could require reimbursement from the developer.
After hearing counsel's advice, the council moved to proceed with the waterline mitigation at 350 North 4th East and the motion received unanimous approval. The council did not record any further plan to pursue reimbursement from the developer.
