The Select Board authorized the Town Manager to sign an Administrative Consent Agreement to resolve a sideyard setback violation at 3 Evergreen Avenue. Community Development Director Christopher Osterrieder explained the administrative consent agreement is used to resolve minor infractions; in this instance no penalties would be charged to the homeowner but the homeowner would be responsible for reimbursing the Town's attorney fees incurred in preparing the agreement.
The motion to authorize the Town Manager to sign and to require reimbursement of attorney-related fees was moved by Lisa J. Pratt, seconded by William Ward, Jr., and passed by a show-of-hands vote of 6-0 with one member absent. The minutes note that the Town's legal counsel prepared the agreement and the applicant and their counsel reviewed it prior to the meeting.
