City of Clermont ordinance raises maximum administrative fines for code violations

Assistant City Attorney Avery Diane briefed the City of Clermont Code Enforcement Board on a recently adopted ordinance that expands the board's authority to impose administrative fines and recover enforcement costs. "As it now stands, the board can issue a fine not exceeding $1,000 per day for a 1st violation," she said, adding repeat violations can carry higher maximums and the ordinance authorizes recovery of administrative enforcement costs.
Diane said the amendment modifies chapter 1, article 2, division 3 of the city code and specifically cited the new section 1-101 as the most applicable provision for the evening's cases. Board members asked for procedural clarifications; staff and counsel noted that the new statutory maximums reflect the city's population bracket and that the board retains discretion in setting fines at or below those limits. The ordinance was presented for the board's awareness and will apply in upcoming enforcement orders where the board deems appropriate.
