The New Smyrna Beach Code Compliance Board approved staff's recommendation May 22 to find Sandra and Richard Landis in violation for installing a post/column at 1 Cunningham Drive without a permit and set a June 30 compliance date.
Officer John Parks reported he observed a new wooden post column during a site visit and found no corresponding permit in the system; an earlier fence permit exists in an expired status. Parks emphasized that the post supports an overhang and is a permitted item because of structural and safety concerns. "We would hope that it would be structurally safe and not be weakened where it would collapse and be dangerous," Parks said. The board voted to accept the recommendation and ordered the respondents to contact the code inspector to verify compliance. The board also reminded respondents of the 30-day appeal window and repeat-violation penalties within five years.
