The New Smyrna Beach Code Compliance Board on May 22 approved staff's recommendation to impose a $50-per-day fine on the owner of 2502 Arlington Avenue for unpermitted work.
Officer Jason Yates said the board previously found Robert Ayers in violation and set a May 8, 2025 compliance date; to date, no permits have been applied for despite multiple conversations. "If the board found that the violations were not corrected by this date, a fine of $50 a day shall be imposed for each day the violation exists," Yates told the board.
Board members moved and seconded acceptance of the officer's report and the motion carried unanimously. Respondents were ordered to contact the code inspector to verify compliance; the board reminded respondents of appeal rights and that repeat violations within five years could result in higher daily fines.
