Board upholds violations at 431 Sheldon St., approves $20-per-day fines

The New Smyrna Beach Code Compliance Board on May 22 found PGSR Holdings LLC in violation of multiple exterior and outdoor-storage codes for 431 Sheldon Street and approved fines for ongoing violations.
Officer Barbara Provolak presented updated photos and a reinspection conducted on May 19 showing that while the property was improved compared to prior months, trash cans and items remained in public view and a cart and palm fronds were blocking the sidewalk. Provolak recommended finding PGSR Holdings LLC in violation of several sections (listed in the board order) from the original compliance date of May 8 through May 18, 2025, and imposing $20 per day per violation for that 10‑day period, totaling $2,000; she also recommended continuing fines for other subsections until full compliance, not to exceed $15,000.
"Compared to what it was, it looks amazing. But they do still have the trash cans in public view," Provolak said. No members of the public attended to respond. A motion to accept staff's recommendation passed. The respondents were ordered to contact the code inspector to verify compliance and were reminded of the 30‑day appeal period and the possibility of increased fines for repeat violations within five years.
