Boyle moved to approve the docket but except Section 410, subsection (g) and (h), citing a potential conflict with Article I, Section 23 of the Idaho Constitution and Idaho Code §§36-201 and 36-103. The committee carried the motion by voice vote.
Chairman Mendive had turned the gavel over to Vice Chairman Shepherd for administrative rules consideration; after the docket motion carried, Vice Chairman Shepherd returned the gavel to the chair. The minutes record the committee taking no further business and adjourning at 8:09 a.m.
The minutes do not record a roll-call vote or statements from opponents of the docket; the exception of the two subsections was specifically noted by Rep. Boyle as the reason for the modified approval.
