The Dewey Beach Planning & Zoning Commission on July 22 moved unanimously to recommend two zoning-code revisions to the town commissioners: a clarified demolition definition focused on structural thresholds and amended rules for projecting elements and encroachments. Both recommendations passed by unanimous votes of the commission.
For the demolition-definition draft the commission asked staff to add FEMA-style cumulative-tracking language (50% over a five-year window), require that the building official's determinations be made 'through town code' and include written determinations citing any engineering reports. For the projecting-elements draft commissioners asked staff to insert the specific green-space code citation and a savings clause allowing existing lawful encroachments to be maintained, repaired and replaced in kind. Staff was assigned follow-up tasks with target dates in mid-August and the commission set its next meeting date for Aug. 26.
