Vice Chairman Shepherd and Chairman Mendive said they had met with Mathew Weaver, Director of the Idaho Department of Water Resources, to relay concerns about unclear definitions and confusing language in Docket No. 37-0307-2501. The resulting committee consensus was to reject the Rule and a motion to reject the docket in its entirety carried by voice vote.
After initial rejection, the committee entertained substitute and amended motions related to rulemaking procedure, including a short hold to allow an RS (request for statute) or additional drafting. Committee members emphasized clarity in definitions and the need for IDWR to return with language that addresses enforcement and statutory consistency.
