Committee approves lake protection rules; IDL adds encroachment definitions and references International Fire Code

Marde Mensinger, Navigable Waterways Program Manager at the Idaho Department of Lands, presented Docket No. 20-0304-2401, a rewrite of rules implementing the Lake Protection Act (Idaho Code § 58‑13). Mensinger said the changes reduce restrictive language, add definitions for common encroachments (including breakwater, seawall, water line, residential area and marine motor fuel dispensing facility), and incorporate the International Fire Code by reference. The Department did not propose fee increases for the rule.
Senator Okuniewicz asked whether higher lake levels at Lake Pend Oreille would change IDL's approval processes for docks and marinas; Mensinger said it would not alter the approval process, though applications might arrive earlier in the season. The committee moved and approved the docket by voice vote.
