Council debates limits of local enforcement after unpermitted adult-oriented event in neighborhood

Council members raised concerns about an unauthorized adult-oriented event that drew crowds and spilled into the street in a residential neighborhood. Members reviewed existing city code and county ordinances and discussed whether the city has legal authority to prevent such events when they occur inside private residences.

One council member urged amendment of the city's adult-entertainment code to match the county template and to make violations a health, safety or welfare offense that could be brought before the magistrate. "Make our adult entertainment ordinances health and safety and welfare violations and take them right before the magistrate and slap them to the fine every time it happens," the councilor said. Other members and staff noted limits imposed by state law and First Amendment and privacy protections that make enforcement difficult when activities occur inside a private dwelling.

Council and staff discussed enforcement paths for activities that spill into public space: blocking streets and driveways, noise and public-safety hazards remain within law enforcement authority, and property-based code remedies (magistrate fines for properties that are out of compliance) may be available. Staff and the city attorney (in discussion) warned that some ordinance provisions have been held unconstitutional and that any local amendment must be carefully drafted. The council asked the city manager and city attorney to review options and coordinate with the Clay County Sheriff's Office on enforcement and public-safety protocols for events that generate exterior disturbances.
