He explained the statutory framework (North Dakota Century Code provisions allow regional airport authorities, with a statutory cap of four mills) and outlined possible governance models and next steps: (1) commission feedback, (2) consultation with the North Dakota Aeronautics Commission and bond advisors, (3) craft a model for representation and levy allocation and (4) review federal/FAA grant-assurance implications.
Commissioners raised detailed questions about mill-levy mechanics (how current local airport levies would interact with a countywide levy), whether certain towns that already levy airport mills could be unchanged, and the potential for countywide mills to replace or supersede local levies. County staff explained that local levies would take precedence over a countywide levy where they already exist and that the county would need to research which jurisdictions fund airports from general funds versus an explicit airport levy. The airport representatives proposed forming a task force and requested that the commission indicate whether to proceed with stakeholder outreach; commissioners asked for time to consider and directed staff to follow up with legal and bonding analyses before any levy or governance decisions are proposed.
