Board grants three variances for 1701 Terrace Drive West despite staff concerns

Karina Maldanado, Senior Community Planner, reviewed PZB 24-01500004 and told the board that staffs analysis of the four variance criteria concluded that only the fourth criterion was met. Maldanado said a 2018 variance for an awning existed, that the current proposal would result in approximately 63% impermeable surface coverage if both the addition and the unpermitted pavers are counted, and that the pavers on the south side appear to cover about 220 square feet and were likely installed after 2022.
Applicant Ibrahim Chalhoub said the project is intended to expand living area because family members have returned to the home, and he argued the setback should be grandfathered. "The setback question should be grandfathered and not be brought up again," Chalhoub said, also noting wildlife and runoff concerns. Board members requested the prior 2018 variance documents for clarity and discussed whether the unpermitted pavers should be grandfathered; the Board Attorney clarified that the current request must address any elements now before the board. On a motion by Daniel Walesky, seconded by Mark Humm, the board voted unanimously to approve the three variances and eliminated one staff condition as part of the approval.
The action permits the proposed enclosure/addition and recognizes the existing site circumstances; staff conditions and the board's findings were recorded in the motion. The applicant and staff were directed to confirm the exact scope of the paver installation and whether prior approvals affect current nonconforming elements.
