The Nutley Zoning Board of Adjustment approved an application to demolish a single‑family house and build a new two‑family dwelling at 117 Saint Mary's Place, after the applicant presented architectural and engineering plans dated April 16, 2026 and the board discussed height, landscaping and stormwater issues. The motion to grant the C‑2 relief and permit the demolition and rebuild passed on roll call and the board said it will memorialize the approval at its next meeting to allow the applicant to pursue permitting.
The applicant's representative read the project scope and cited relevant provisions of Chapter 700; the application record shows the proposed front‑yard landscaping was 36.8% compared with a 60% requirement. Architect Joseph Haines described the design as two mirrored units with garages under, separate entrances and three bedrooms upstairs. During questioning the applicant's team said they had prepared streetscape photos and that the civil engineer's calculations indicate no net runoff to adjacent properties.
Father Thomas, who was sworn as a witness and identified himself as a neighbor and pastor, said he and members of his congregation reviewed the rendering and were comfortable with the design's fit with the block. "I am very confident with their explanation and speaking with my staff," he said. The board discussed the midpoint height (reported on the record as roughly 32 feet 10 inches) and asked the team to reduce roof pitch and provide clarification in the file; the applicant said those elevations and streetscape exhibits were submitted for the record.
Conditions attached to approval require that the bonus room not be used as a bedroom, that a center pathway exhibit be provided to increase front‑yard landscaping percentage, and that the applicant submit/confirm the engineer's runoff calculations. The board made the approval contingent on those conditions and on memorialization of the resolution at the next meeting; once memorialized the applicant may proceed to apply for building permits.
The board recorded the motion, the second, and a roll‑call vote in which members present approved the motion. The board clerk will include the precise memorialized resolution and vote tally in the minutes filed with the municipal office.
