“...we have to reinstate this tax,” Mr. Freeman said during the council discussion, describing the council’s options after legal review and negotiations. Jake moved the motion to repeal the 2024 ordinance and reinstate the 2007 cooperation agreement; Jordan seconded. The council carried the motion on a roll call with five yes votes.
The ordinance action followed the council’s summary of past steps: the city had previously repealed the tax and later learned it lacked legal authority to do so, which exposed it to a potential claim for unpaid taxes. Council members said they had negotiated to avoid paying back taxes but needed to restore the ordinance to comply with legal requirements.
