Waverly upholds rental-license fines but pauses new penalties while repairs progress

The council reviewed appeals from rental property owners who sought waiver of fines assessed for failing to complete rental license applications and inspections by the April 15, 2026 deadline. Staff confirmed notices had been mailed Feb. 19 and March 18.
For Jodi Kust (three rental properties) the council upheld two $500 fines for late compliance but directed that no additional fines be assessed on 306 5th Street North as long as the owner remains in contact with the city and actively pursues the required foundation repairs; the motion (Jacobson/Duske) passed unanimously. For CCK Properties (302 2nd Street North) the council also upheld the assessed fine; the motion (Koch/Duske) carried 4-0 with Commissioner Jim Kittock abstaining due to a conflict of interest. Attorney Pagel suggested special-assessment agreements would generally not be appropriate for rental owners but left open exceptional cases to be considered individually. The council also asked Metro West to keep a complete contact log for scheduling and documentation.
