Council debates TIF expansion, annexation and a proposed moratorium on data centers

Council and staff debated a package of redevelopment measures that included terminating the Global Trade Park South TIF, creating a new South Rockford Industrial TIF, annexation of land south of the airport, and measures aimed at limiting TIF benefits for data centers. Administrator Kagnoni told council the establishing ordinance for the proposed TIF would expressly exclude data centers from receiving TIF benefits.
Kagnoni described a recommended six-month moratorium on new data-center permits to give staff time to draft zoning regulations and best-practice development standards, and said the moratorium would include property under consideration for annexation by Venture One/Mark Good. He explained existing annexation agreements for properties previously annexed (2008, 2011) could supersede a moratorium for those parcels, and for properties under a new annexation agreement (the item requiring 10 votes) the proposed agreement would include a prohibition on data centers.
Council members and members of the public debated what the city could require: Ald. Meeks and others asked whether developers could be required to pay for independent studies on electrical grid impacts, water use, wastewater and emergency-service impacts. Kagnoni said staff believe many of those developer-funded studies can be required but legal review will be needed to confirm enforceability. Several residents and speakers urged stronger zoning text amendments, independent environmental reviews and guarantees on decommissioning and community benefits before large industrial uses are permitted.
On the floor council recorded votes reversing prior committee denials into approvals for some annexation and zoning items; the transcript records roll-call votes on multiple items. Council and staff agreed to pursue text amendments and a moratorium referral to Code & Regulation so the city can craft regulatory standards and the financing elements of the TIF can proceed with data-center exclusions.
