Bureau of Planning and Sustainability staff presented a franchise transfer request from Zenith Energy Terminal Holdings LLC to ISQ Springer Holdings LLC for piping that runs under Northwest Front Avenue and supports a bulk fuel terminal. Staff summarized the city's scope under the franchise agreement: the city may evaluate the transferee's technical, legal and financial capacity but cannot renegotiate the core franchise terms through the transfer process.
Staff reported ISQ operates similar facilities in other jurisdictions, plans to staff the terminal with experienced operations personnel, will retain local counsel for compliance, and has parent-company backing. "Based on our review of the criterion in section 8 of the agreement — the technical, legal, and financial — we believe ISQ has sufficient qualifications to operate the facility," staff said. Because 53 people had signed up for testimony, the committee continued the item to the Aug. 6 meeting to allow public testimony and further technical questions.
