Counsel explained that clearing the variance process with the ZBA would not automatically authorize a business use from the detached garage and that applicants must seek the Town Board's special-permit review.
The warning came amid conflicting descriptions of the structure’s intended use: the environmental assessment filed with the application described "storage" while the architect and applicant described a home-office for a cleaning business, and a three-fixture bathroom has already been installed. Counsel urged the applicant to treat the ZBA variance and the Town Board special-permit as two distinct steps in the approval process.
