The Gregory City Council declared the property at 524 E 6th surplus and set a sale value of $12,000 after City Attorney Rachelle Norberg explained Gregory County had seized the lot for unpaid taxes and therefore did not hold clear marketable title. Norberg said the city received the property via quitclaim deed and that the city can sell using a quitclaim deed, but purchasers may need to pursue a quiet-title action at their own expense if title defects remain.
Councilmember Stacey Boes moved to declare the property surplus and set the value at $12,000; Alex Hamilton seconded and the motion passed unanimously. The council did not set a sale date; the minutes note the purchaser would bear the cost and responsibility of any quiet-title action necessary to obtain clear title.
