The Town of Born Planning Board voted unanimously on July 23 to accept an applicant's withdrawal of a definitive subdivision application for 115 Redbrook Harbor Road and to accept the town council's July 21 determination that the lot is buildable.
A presenter updated the board that research submitted by the applicant's attorney at Dalton and Feingold, along with town-record review, showed the parcel met an older frontage standard and town council had confirmed that conclusion. The presenter told the board the applicant had formally withdrawn the subdivision filing and asked the planning board to accept that withdrawal tonight and consider a lot release at a subsequent meeting.
Resident Surendra Shaw of 121 Redbrook Harbor Road spoke in support of the council's decision. "I'm very pleased that where we have come to on the decision by the town council," he said, and thanked planning-board members and staff for being responsive to his queries.
The board first voted to accept the withdrawal and then separately moved to accept town council's determination that the parcel is grandfathered and buildable. Chair recorded the vote as unanimous. The board indicated it will place a lot-release item on the next meeting agenda to complete the procedural sequence.
