North Canaan commission begins review of table of uses and definitions; fencing and pool permit rules discussed

Commissioners agreed to begin updating the zoning regulations' table of uses and definitions to reduce ambiguity. The discussion focused on whether items listed in the table of uses must also appear in the definitions and on fencing standards: commissioners noted that fences under 7 feet currently do not require a building permit and that imposing a setback could severely limit space for fences in downtown properties.
Cheryl Duntz from the Building Officials Office recommended bringing the town's regulations into closer alignment with building-office and Fire Marshal codes and said she would email her notes to the chairman and the ZEO. Duntz also stated that everything in the table of uses should be defined and reminded the commission that building permits are required for both inground and above-ground pools. The commission decided to start a formal review and updating process for the table of uses and definitions.
