Council approves encroachment license for 103 Main Street with commercial-use amendment

Senior Planner Ned West presented Resolution No. 38-26 proposing an encroachment license for 103 Main Street to support a renovated storefront, stairs and outdoor seating facing Lake Dillon Drive. West said the owners plan to renovate, add glass frontage and create an ADA-accessible entry and that some trees would be thinned for visibility.

Council member Ben (identified in the discussion by colleagues) moved to amend the encroachment language to add "for commercial purposes" to section 1 of the agreement; the motion was seconded and approved by roll call. Council discussed whether the agreement should be revocable, asked that final plans be returned for review before large renovations proceed, and discussed the applicant's intent to occupy the entire building with an office tenant in the near term and seek a cafe in the long term.

Concerns raised included ensuring the encroachment does not allow residential conversion without proper zoning review and setting expectations about plan submittal and possible revocation if the proposed use is not consistent with the town's objectives. After discussion and the successful amendment, the council voted to approve Resolution 38-26 as amended.
