Marker 33 association ordered to resume structural repairs; magistrate sets $50/day fine until permits issued

City staff told the magistrate that Unit 2C8 at Marker 33 Association (520 South Peninsula Avenue) remains out of compliance under the International Property Maintenance Code for exterior walls and that recent permit activity is still in resubmittal status.
Andy Silvers, speaking for the association's board, said the unit owner has been "dealing with this nightmare for, like, 7 years" and that the board has contracted East Florida Construction and plans a board meeting to address funding. Magistrate Mark Watts said the case shows significant structural, life-safety issues and entered an order starting a reduced fine of $50 per day that will stop once required permits are issued and staff confirms inspections.
"I'm gonna go ahead and enter an order, beginning a $50 a day, running until permits are issued and schedule this for a status check to come back in November," Watts said. City staff explained that once permits are issued and inspections scheduled, the fine would cease; if permit review is delayed by staff resubmittal cycles, that can affect timing.
The magistrate urged close communication between the association, its contractor and the building department and left an option to bring the case back sooner for a progress report if the permits are issued earlier.
