Merchantville Borough Council adopted Ordinance 26-10 on June 8, 2026, amending Articles VIII and VIIIA of Chapter 94 (Zoning) to permit Cannabis Retailers as conditional uses in the B-1 Central Business and B-2 Neighborhood Business districts. On the motion of Councilmember Ray Woods, seconded by Councilmember Sean Fitzgerald, council approved the ordinance, which states it is enacted pursuant to the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (N.J.S.A. 24:6I-31 et seq.) and the municipal conditional-use statute (N.J.S.A. 40:55D-67).
The ordinance sets explicit hours of operation for any cannabis retailer: 9:00 a.m. to 10:00 p.m. Mondays through Saturdays and 9:00 a.m. to 10:00 p.m. on Sundays. The measure was adopted to add conditional-use language and will take effect upon passage and publication according to law. Council did not record a roll-call tally in the published minutes; the motion and second are recorded in the meeting minutes.
